These Terms govern your use of The Gundog Journey (the "Service"), operated by Mr Paul Anthony Joseph Daly, sole proprietor trading as Gundog Training Northampton ("we", "us", "our"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

The Gundog Journey is a training diary, AI coach, and progress tracker for gundog handlers. We may add, change, or remove features at any time.

2. Your account

You must provide accurate information and keep it up to date. You are responsible for the confidentiality of your account credentials and for all activity under your account. If you are using the Service on behalf of an organisation, you confirm you have authority to bind that organisation. If you are an individual, you confirm you are of legal age to enter into a contract.

3. Acceptable use

You must not:

  • Use the Service unlawfully or to send fraudulent, infringing, or harmful content.
  • Interfere with the Service's security, probe it, scrape it, or upload malware.
  • Reverse engineer, resell, or redistribute the Service or circumvent its limits.
  • Use the AI coach to generate illegal content, hate speech, deepfakes, malware, or content that infringes third-party rights. You are responsible for your prompts and how you use any outputs, and you must have the rights to any content you input.

We may remove content, refuse or filter AI outputs, and suspend accounts that breach these rules. We may also terminate access for material breach, non-payment, security or fraud risk, or repeated policy violations.

4. AI outputs and accuracy

The AI coach and AI-generated session insights may be inaccurate, incomplete, or out of date. They are general guidance only and are not a substitute for in-person professional gundog training, veterinary advice, or legal/regulated advice. You are responsible for verifying outputs and deciding how to apply them with your dog.

5. Intellectual property

We retain all rights, title, and interest in the Service, including its software, content, and branding. You receive a limited, non-exclusive, non-transferable right to use the Service within the plan you've selected. You retain ownership of your own content (dog profiles, session notes, photos) and grant us a limited licence to host and process it solely to provide the Service to you.

6. Payments, billing, and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. See our Refund Policy for our 30-day money-back guarantee.

7. Service availability and warranties

We do our best to keep the Service running, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

8. Liability

To the fullest extent permitted by law, our aggregate liability arising out of or related to the Service is limited to the fees you paid us (via Paddle) in the 12 months before the event giving rise to the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence where the law does not permit exclusion.

You agree to indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

9. Termination

You may stop using the Service at any time and cancel your subscription via Paddle. We may suspend or terminate your access for the reasons listed in section 3, or if required by law. On termination your right to use the Service ends. We will retain your data for a reasonable period to allow export, then delete it in line with our Privacy Notice.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email or in the app. Continued use after the change date means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of England and Wales. Disputes will be heard in the courts of England and Wales.
